1. About these Terms
This website is operated by:

In these Terms of Use:
- Panosh Place, we, us and our refer to the business identified above;
- website means the Panosh Place website and its associated online store;
- you and your refer to the person accessing the website or purchasing from Panosh Place;
- product includes any goods offered through the website; and
- order means an order submitted through the website or otherwise accepted by Panosh Place.
These Terms apply to:
- your access to and use of the website;
- orders placed through the website;
- Click & Collect orders;
- pre-orders;
- special orders where these Terms are incorporated into the quote or acceptance; and
- other transactions expressly stated to be subject to these Terms.
By accessing the website or placing an order, you agree to these Terms.
These Terms must be read together with our:
- Privacy Policy;
- Refund and Returns Policy;
- Pre-Order Policy;
- Special Order Policy; and
- any published Shipping and Transit Protection Policy.
Those policies form part of these Terms where relevant to your use of the website or purchase.
If there is an inconsistency between these Terms and a product-specific term disclosed before purchase, the more specific term will apply to that product to the extent of the inconsistency. Nothing in these Terms or another Panosh Place policy limits a right that cannot lawfully be excluded.
2. Australian Consumer Law
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, you may be entitled to a repair, replacement, refund, cancellation or compensation where a product or service does not comply with those guarantees.
For a major failure with a product, you may be entitled to choose between a refund and replacement. For a failure that is not major, Panosh Place may be entitled to provide an appropriate remedy within a reasonable time.
You may also be entitled to compensation for reasonably foreseeable loss or damage caused by a failure to comply with a consumer guarantee.
Nothing in these Terms excludes, restricts or modifies:
- a consumer guarantee;
- a right or remedy under the Australian Consumer Law; or
- any other right or liability that cannot lawfully be excluded, restricted or modified.
Any voluntary warranty, change-of-mind policy or other benefit offered by Panosh Place is additional to your rights under the Australian Consumer Law.
3. Eligibility and lawful use
You must be at least 18 years old to place an order, or have the permission and supervision of a parent or legal guardian.
You must use the website only for lawful purposes.
You must not:
- use the website fraudulently or dishonestly;
- impersonate another person;
- provide false, misleading or incomplete information;
- attempt to obtain unauthorised access to the website, an account or another customer’s information;
- interfere with the website’s operation, security or availability;
- introduce malicious code, automated attacks or harmful material;
- scrape, copy or extract website content for commercial use without permission;
- use automated purchasing tools or bots in a way that disadvantages genuine customers;
- place orders that you do not intend or are not authorised to pay for; or
- use the website in a way that breaches any applicable law.
We may take reasonable steps to prevent suspected fraud, misuse, security threats or unlawful activity.
4. Customer accounts
You may be able to purchase as a guest or create a customer account.
You are responsible for:
- providing accurate and current information;
- maintaining the confidentiality of your password;
- taking reasonable steps to secure your account; and
- notifying Panosh Place promptly if you suspect unauthorised access or use.
You must not:
- share your account with an unauthorised person;
- use another person’s account without permission;
- disclose passwords or authentication codes to Panosh Place staff or automated assistants; or
- attempt to access another customer’s orders or personal information.
Panosh Place will never ask you to provide your complete payment-card number, card security code, account password or third-party multifactor authentication code through website chat or email.
We may temporarily restrict or suspend access to an account where reasonably necessary to investigate suspected fraud, misuse, unauthorised access or a security risk.
Suspending an account does not remove any rights relating to an existing order or the Australian Consumer Law.
5. Website and product information
We take reasonable care to ensure that information on the website is accurate and current.
However:
- colours may display differently depending on your device;
- product packaging may be updated by the manufacturer;
- dimensions and weights may be approximate;
- manufacturer information may change;
- release and arrival dates may be estimates;
- product images may be illustrative unless the listing states that the exact item pictured will be supplied; and
- availability may change before an order is accepted.
The product listing, including any condition description, photographs and product-specific terms, should be reviewed before purchase.
Where a product is described as second-hand, vintage, pre-owned or otherwise not new, reasonable age-related or disclosed condition characteristics may be present. These characteristics do not affect your rights where the product is materially misdescribed or does not meet an applicable consumer guarantee.
Unless expressly stated otherwise, product information is provided for retail and collecting purposes. It is not financial, investment, insurance, grading or authentication advice.
Panosh Place does not guarantee:
- future product value;
- resale value;
- investment performance;
- a third-party grading outcome; or
- the future rarity or collectability of a product.
6. Randomised, sealed and collectible products
Some products may contain manufacturer-selected, blind, mystery or randomised contents.
Purchasing such a product does not guarantee that you will receive:
- a particular card;
- a particular character;
- a chase item;
- a particular rarity;
- a complete set; or
- any other preferred randomised outcome,
unless the product listing expressly states otherwise.
Not receiving a desired randomised item is not, by itself, a product fault.
Trading-card packs, blind boxes, mystery products and other sealed randomised products may be excluded from voluntary change-of-mind returns once opened. This does not limit rights relating to a faulty, misdescribed or non-compliant product.
7. Prices and payment
Prices are displayed in Australian dollars unless expressly stated otherwise.
The price payable is the price displayed at checkout when your order is submitted, subject to:
- any clearly disclosed shipping charge;
- applicable taxes or duties;
- an approved special-order quote;
- a genuine and obvious pricing error; and
- any other amount clearly disclosed before you submit the order.
Available payment methods are displayed at checkout.
Payment must be authorised and received in accordance with the selected payment method before an order is dispatched or released for collection.
Your bank, payment provider or cryptocurrency provider may impose separate fees or conversion charges. Panosh Place is not responsible for fees imposed independently by those providers.
Panosh Place does not store complete payment-card details. Payments may be processed by third-party payment providers under their own terms and privacy practices.
8. Orders and contract formation
Placing an order through the website is an offer by you to purchase the selected products on the displayed terms.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that:
- the order has been finally accepted;
- payment has cleared;
- stock has been physically verified;
- the selected shipping service is suitable; or
- a preorder allocation has been confirmed.
An order is accepted when Panosh Place confirms acceptance, begins fulfilment or dispatches the product, whichever occurs first.
We may review an order before acceptance, including where:
- stock information appears incorrect;
- a product or price contains a genuine and obvious error;
- payment has not been authorised or received;
- the order appears fraudulent or unauthorised;
- the product cannot lawfully or safely be supplied;
- the selected delivery service is unsuitable;
- a carrier will not accept the product;
- a supplier allocation affects a preorder; or
- additional information is reasonably required.
Where an obvious pricing or listing error is identified before acceptance, we may contact you and offer the choice to:
- proceed on the corrected terms; or
- cancel the affected product and receive a full refund.
We will not substitute a materially different product, edition or variant without your agreement.
Where we cannot accept or fulfil an order, we will notify you and refund the affected amount paid to the original payment method.
9. Product availability
Products are subject to availability.
Adding a product to your cart does not reserve it.
Panosh Place does not offer unpaid holds or reservations.
A product is not reserved until:
- the order has been submitted;
- the required payment has been received; and
- the order has been accepted.
In the uncommon event that a product becomes unavailable after payment, we will contact you and offer:
- a refund for the unavailable product;
- an alternative product with your agreement; or
- another appropriate solution accepted by you.
You are not required to accept store credit or a substitute product where Panosh Place cannot supply the product ordered.
10. Order changes and customer cancellations
A request to change or cancel an ordinary order should be made as soon as possible.
We cannot guarantee that an order can be changed or cancelled after:
- fulfilment has commenced;
- a shipping label or carrier booking has been created;
- the product has been dispatched; or
- a customer-specific supplier commitment has been made.
Any approved change may require payment of:
- an additional product amount;
- additional shipping;
- a carrier redirection or cancellation charge; or
- another reasonable cost directly resulting from the requested change.
Preorders and special orders have separate cancellation conditions under their respective policies.
Nothing in this section limits your rights where Panosh Place fails to comply with a consumer guarantee.
11. Preorders
Products clearly identified as Pre-Order are governed by our Pre-Order Policy.
Preorders may involve:
- full payment;
- a disclosed deposit and later balance;
- estimated release or arrival dates;
- supplier allocation limits;
- delayed fulfilment; or
- combined shipping with other products.
Release dates, supplier arrival dates and allocation information are estimates unless expressly confirmed otherwise.
You should review the Pre-Order Policy and the relevant product listing before placing a preorder.
12. Special orders
A special order is a customer-requested product that Panosh Place does not ordinarily stock and that is not listed as a normal website preorder.
Special orders are governed by our Special Order Policy and any written quote accepted by you.
Special orders are subject to:
- supplier confirmation;
- product verification;
- written pricing;
- the stated payment requirement;
- estimated timing;
- shipping requirements;
- customer-specific purchasing commitments; and
- the cancellation conditions disclosed before acceptance.
Full payment is normally required before Panosh Place places a special order with a supplier. A deposit applies only where specifically quoted and approved.
Change-of-mind cancellation is not normally available after Panosh Place has made a customer-specific supplier commitment.
Nothing in the Special Order Policy limits your Australian Consumer Law rights.
13. Shipping and delivery
Panosh Place ships throughout Australia and internationally where a suitable service is available.
Shipping methods, charges and destination availability are determined through:
- the website checkout;
- a written quote; or
- direct communication where manual review is required.
Delivery dates and timeframes are estimates unless expressly identified as guaranteed.
Panosh Place selects carriers and any applicable transit protection as part of its internal fulfilment process. Transit protection is not sold as optional customer insurance and does not limit Panosh Place’s obligations or your rights under the Australian Consumer Law.
Some products may require:
- manual shipping review;
- a different carrier;
- additional packaging;
- a delivery signature;
- an additional shipping charge;
- separate dispatch;
- Click & Collect; or
- cancellation and refund where no suitable delivery service is available.
This may apply particularly to high-value, fragile, restricted, oversized, unusual or internationally regulated products.
We ordinarily use tracked services and may require a delivery signature.
Authority to Leave may be unavailable or unsuitable for some orders. Where it is not offered at checkout or approved in writing, you must not assume that Authority to Leave applies.
Delivery to a PO box or parcel locker is available only where a compatible service is offered.
We do not guarantee that a carrier will be able to:
- redirect a parcel;
- change a delivery address;
- stop an item in transit;
- return an item before delivery; or
- meet an estimated delivery date.
Additional carrier charges resulting from a customer-requested change may be payable by the customer where disclosed and approved.
14. Lost or damaged parcels
If a parcel arrives damaged, please contact Panosh Place as soon as possible, preferably within 48 hours.
You should retain:
- the product;
- the outer shipping carton;
- all internal packaging;
- the shipping label; and
- photographs showing the product, packaging and damage.
Do not dispose of, repair or return a damaged product until Panosh Place provides instructions, as the carrier may require photographs or inspection.
The preferred 48-hour notification period assists us in meeting carrier claim requirements. It does not remove or reduce any right available under the Australian Consumer Law.
If tracking indicates that a parcel may be lost, contact Panosh Place promptly so that we can investigate with the carrier.
Panosh Place will manage the carrier enquiry or claim as the sender where applicable. The carrier-claim process and your rights against Panosh Place are related but separate. A carrier’s decision about transit protection does not determine whether you have a remedy under the Australian Consumer Law.
15. International orders
International shipping is available only where:
- the destination is supported;
- the product may lawfully be exported and imported;
- an appropriate carrier service is available; and
- the checkout or Panosh Place confirms the shipping arrangement.
You are responsible for checking whether a product may lawfully be imported into your destination.
Unless the checkout or written quote expressly states otherwise, the recipient is responsible for:
- import duties;
- customs charges;
- destination taxes;
- brokerage charges; and
- other charges imposed by an overseas authority or carrier.
International shipments may be delayed or inspected by customs or border authorities.
We are not responsible for delays caused solely by customs or government processing. Where a parcel is refused, abandoned or returned because charges were not paid or import requirements were not met, reasonable return and carrier costs may be deducted from any refund to the extent permitted by law and clearly attributable to the order.
16. Combined orders and split shipping
Orders containing both in-stock and preorder products will ordinarily be dispatched together when all products are available.
Orders containing preorders with different expected arrival dates will also ordinarily be dispatched after the final product becomes available.
You may request split shipping. Split shipping:
- requires staff approval;
- may not be available for every product or destination; and
- requires payment of any additional delivery charge before the additional shipment is booked.
Panosh Place may require products to be shipped separately where their size, value, fragility, location or carrier restrictions make combined shipment unsuitable.
17. Click & Collect
Free Click & Collect may be offered at checkout for eligible products.
You should wait until you receive confirmation that the order is ready before attending the store.
Click & Collect orders may be collected during advertised opening hours by:
- the purchaser; or
- an authorised representative nominated through an approved process.
Payment must be confirmed before the order is released.
Identification or additional verification may be requested for higher-value orders or where reasonably necessary to prevent fraud.
An order must be collected within any timeframe stated in the ready-for-collection notification. Contact Panosh Place where you are unable to collect within that period.
18. Returns and refunds
Returns, refunds, repairs, replacements, exchanges and change-of-mind requests are governed by our Refund and Returns Policy.
Change-of-mind returns are a voluntary benefit and may be subject to:
- notification periods;
- product-condition requirements;
- proof of purchase;
- return authorisation;
- category exclusions;
- customer-paid return shipping; and
- another condition stated in the Refund and Returns Policy.
Those voluntary conditions do not apply where they would limit a right under the Australian Consumer Law.
Do not send a product back without contacting Panosh Place first unless the published Refund and Returns Policy expressly permits it.
19. Promotions and discount codes
Promotions and discount codes may be subject to additional terms disclosed with the promotion.
Unless expressly stated otherwise:
- a promotion applies only during the advertised period;
- a discount cannot be exchanged for cash;
- one discount code may be used per order;
- discounts cannot be applied retrospectively;
- discounts may exclude selected products, preorders, special orders or categories; and
- discounts cannot be combined with another promotion.
A promotion does not reduce or replace Australian Consumer Law rights.
Where promotional wording conflicts with these Terms, the specific promotional terms will apply to the promotion to the extent of the inconsistency.
20. Gift cards and vouchers
Where Panosh Place offers gift cards or vouchers, any specific conditions displayed at purchase or issue form part of these Terms.
Gift cards and vouchers:
- may be used only through the channels for which they are issued;
- cannot ordinarily be exchanged for cash except where required by law;
- must not be obtained or used fraudulently; and
- remain subject to applicable Australian gift-card laws.
Panosh Place may require reasonable verification before replacing or investigating a gift card or voucher reported as lost, stolen or used without authority.
21. Intellectual property
Unless otherwise stated, the website and its original content are owned by or licensed to Panosh Place.
This includes:
- text;
- graphics;
- photographs;
- logos;
- icons;
- page designs;
- databases;
- videos;
- sound recordings; and
- software.
Third-party brands, product images, character names and trademarks remain the property of their respective owners.
You may view and print website content for personal, non-commercial use.
Without prior written permission, you must not:
- reproduce or republish substantial website content;
- modify or create derivative works from our original content;
- use our branding in a misleading way;
- frame or mirror the website;
- commercially exploit website content;
- remove copyright or ownership notices; or
- suggest that Panosh Place endorses an unauthorised product, service or business.
Nothing in these Terms transfers ownership of any intellectual property to you.
22. Third-party links and services
The website may contain links to third-party websites or use third-party services, including:
- payment providers;
- shipping providers;
- social-media platforms;
- embedded content;
- analytics services; and
- external product-information sources.
Third-party links are provided for convenience and do not necessarily constitute endorsement.
Panosh Place does not control third-party websites and is not responsible for their independent:
- content;
- security;
- availability;
- privacy practices; or
- terms of use.
Your use of a third-party service may be governed by separate terms between you and that provider.
This section does not limit Panosh Place’s responsibility for services it chooses to use in fulfilling an order.
23. Privacy and communications
Personal information is collected, used, stored and disclosed in accordance with our Privacy Policy.
We may use the contact details associated with your order to communicate about:
- payment;
- verification;
- availability;
- preorders;
- special orders;
- delivery;
- Click & Collect;
- delays;
- returns;
- refunds;
- security concerns; and
- other matters reasonably necessary to administer the transaction.
Order-related communications are not marketing communications.
Marketing communications will be sent only in accordance with applicable law and your preferences. You may unsubscribe from marketing without affecting necessary transactional communications.
Data transmitted over the internet cannot be guaranteed to be completely secure. Panosh Place takes reasonable steps to protect personal information once received, but you should also take appropriate precautions when using online services.
24. Website availability
We aim to keep the website available and operating correctly, but continuous or error-free access is not guaranteed.
We may suspend, restrict or modify the website where reasonably necessary for:
- maintenance;
- upgrades;
- security;
- legal compliance;
- technical problems;
- fraud prevention; or
- changes to the business or services.
Where reasonably practical, we will seek to minimise disruption.
Temporary website unavailability does not affect rights relating to an existing accepted order.
25. Liability
Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded.
To the extent permitted by law, Panosh Place is not liable for loss that:
- was not reasonably foreseeable;
- was not caused by a breach, negligence or unlawful conduct by Panosh Place;
- resulted from your unlawful or unauthorised use of the website;
- resulted from inaccurate information supplied by you; or
- resulted solely from a third party outside our reasonable control.
Panosh Place is not responsible for speculative loss arising from changes in:
- collectible values;
- resale markets;
- grading outcomes;
- scarcity;
- demand; or
- investment performance.
This does not limit liability for a misleading product representation, breach of contract, failure to comply with a consumer guarantee or another liability that cannot lawfully be limited.
26. Events outside reasonable control
Panosh Place is not responsible for delay or failure caused by an event outside its reasonable control, including:
- natural disaster;
- fire or flood;
- epidemic or pandemic;
- industrial action;
- war, civil unrest or terrorism;
- government restriction;
- customs or border delay;
- widespread carrier disruption;
- major telecommunications or internet failure;
- supplier or manufacturer interruption; or
- another comparable event.
We will take reasonable steps to minimise the effect of the event and communicate material impacts where practical.
This section does not permit Panosh Place to retain payment where we cannot supply a product and a refund is required by law or an applicable policy.
27. Suspension and termination
We may suspend or terminate access to the website or a customer account where reasonably necessary because of:
- a material breach of these Terms;
- suspected fraud;
- unauthorised access;
- abusive or threatening conduct;
- unlawful activity;
- interference with the website;
- misuse of customer information; or
- a significant security risk.
Where appropriate and lawful, we may provide notice or an opportunity to address the issue.
Suspension or termination does not affect:
- accrued rights;
- existing consumer guarantees;
- refund obligations;
- payment obligations already properly incurred; or
- provisions intended to continue after termination.
28. Changes to these Terms
Panosh Place may update these Terms by publishing a revised version on the website.
Changes ordinarily apply to:
- website use occurring after publication; and
- orders placed after publication.
The Terms and policies accepted when an order was placed will ordinarily continue to govern that order.
We will not retrospectively impose a materially less favourable price, payment, cancellation or fulfilment term on an existing order unless:
- you agree;
- the change benefits you;
- the change is required by law; or
- the change is reasonably necessary to comply with a legal or regulatory obligation without unfairly disadvantaging you.
The “Last updated” date at the beginning of these Terms identifies the current version.
29. Governing law
These Terms are governed by the laws in force in Queensland, Australia.
The parties submit to the courts and tribunals having jurisdiction in Queensland, subject to any right you have to bring a claim in another jurisdiction under applicable consumer law.
Nothing in this section limits any non-excludable jurisdictional right available to a consumer.
30. General provisions
If any provision of these Terms is invalid, illegal or unenforceable, it will be read down to the minimum extent necessary or severed. The remaining provisions will continue to apply.
A failure or delay by Panosh Place in exercising a right does not waive that right.
A waiver is effective only where it is given in writing by an authorised representative.
Panosh Place may assign or transfer its rights and obligations as part of a genuine sale, restructure or transfer of the business, provided this does not materially reduce your existing consumer rights.
You may not transfer your rights or obligations under an order without our written agreement, except where the law permits otherwise.
These Terms, the incorporated policies, the relevant product listing and any accepted written quote constitute the agreement applying to the relevant transaction.
